Understanding Sex-Based Discrimination

Law Blog

Your gender or sex should have no basis on your job or how the people at your job treat you. Unfortunately, many people are still affected by discrimination based on sex and gender. If you feel you are discriminated against at work, it may be necessary for you to hire an attorney to combat this discrimination. You may be eligible to receive compensation. Laws are in place to help you avoid discrimination at work.

What Is Sex-Based Discrimination?

Discrimination based on sex and gender occurs when somebody is treated poorly or is harassed at work on the basis of sex or gender. They may experience negative treatment based on a number of factors, including their affiliation with their gender or sex. This type of discrimination is illegal and no one should not be treated poorly based on whether or not they conform to gender or sex stereotypes or traditional views.

What Is Sexual Harassment?

Sexual harassment is a form of discrimination, but not all discrimination is harassment. Harassment may encompass a variety of unwanted behaviors, including demands for sexual favors, verbal or written comments, and unwanted touching. Sometimes sexual harassment comes in the form of disparaging comments made about one's gender or sexuality. In the workplace, this kind of behavior is inappropriate and illegal.

What Are Examples of Discrimination?

There are several types of discrimination that are based on sex. Discrimination can occur in the process of interviewing, hiring, firing, providing employee benefits, compensating, promoting, and demoting people in the workplace.

For instance, somebody could be denied a promotion based on the fact that they are a man in a female-dominated workspace. A woman could be denied her job after she returns from maternity leave, which is also a form of gender discrimination. Another example is if someone is told that they need to be more feminine or masculine in order to work in the position. In other cases, a woman may have been paid less than a man while they were in the same position.

Discrimination on the basis of gender or sex can also come when an employer refuses to hire an employee based on their family responsibilities. Another example would be if heterosexual employee's spouses received health benefits but homosexual employee's spouses did not. It can be confusing to navigate the many aspects in which discrimination occurs.

What Can You Do?

If you have faced discrimination in the workplace, it is a good idea to speak with a professional attorney who works in anti-discrimination law. You do not have to work in a toxic environment that leaves you feeling that you have been mistreated.
